We provided comprehensive legal advice to a contractor performing one of the largest projects of the local authorities in southern Poland. The contractor claimed indexation of its remuneration in the wake of a drastic rise in the costs of the project performance.
Our support included devising legal argumentation in support of the legitimacy and reasonability of contract modification as well as having a leading role in several-month mediations. We also drafted a settlement to amend the contract and adjust it to the new circumstances of its performance.
Thanks to our advice, our client concluded a settlement under which its remuneration was increased by nearly PLN 110 million. We are glad that our arguments convinced the contracting entity to conclude a settlement and to make the payment now instead of engaging in a long dispute (which translates into the actual value of funds received by our client).
