JDP supported a client in a complex internal investigation into suspected misappropriation of company funds through fictitious service arrangements. The matter involved an employee and an external supplier, with potential losses amounting to millions of zlotys.

The JDP team designed and conducted an investigation covering five years of accounting and transactional records, including invoice verification, contract analysis, employee interviews and a review of relevant communications. A key stage was a meeting with the supplier, during which structured questioning and confrontation with the evidence gathered helped clarify how the scheme operated and obtain information needed for the client to decide on further action.

The final report confirmed the existence of the fraudulent scheme, identified the individuals and entities involved, and set out the key areas of risk. It also provided practical recommendations from a criminal law, tax and compliance perspective, including measures to strengthen internal procedures.

The matter required close cooperation between JDP’s White Collar Crime, tax, employment and compliance experts. Our advice helped the client establish the facts, assess its legal and financial exposure, and implement remedial measures. It also supported the management board in documenting its response to the identified irregularities and the oversight exercised.

The matter was handled by Magdalena Zasiewska, Arkadiusz Górski, Barbara Kaczała under the supervision of Marcin Chomiuk, PhD.
