In the recent months, our client was facing a threat of company hijacking by its “former shareholder”. One of the elements of this malpractice was filing for a pre-litigation injunction consisting in declaring that our opponent was an actual shareholder of our client. Had the court granted the injunction sought, our opponent would have taken over the actual control over the company.
However, thanks to our swift reaction, supported by expeditiously gathered evidence and convincing arguments, the first-instance court dismissed the motion for injunction, and in the second instance the court dismissed the appeal of our opponent.
