JDP lawyers represented a leading general contractor in mediation with a major public employer in the Polish Armed Forces sector. The case concerned an investment project carried out for the army, i.e. a project of particular importance for national security, subject to specific legal, organisational and formal constraints.
The subject of the mediation was multi-million contract claims arising from settlements between the parties during the project. The procedure required not only in-depth knowledge of contract law and the public procurement regime, but also efficient navigation of the realities of defence projects, including extensive decision-making structures and restrictions on access to classified information.
The mediation resulted in a settlement agreement being concluded less than 10 months after the application was filed, which, considering the scale and specific nature of this type of undertaking and the number of decision-makers involved, should be regarded as an exceptionally efficient and effective conclusion of the process.
The case demonstrated, in particular:
- the high credibility of JDP lawyers in negotiations with the defence sector;
- a deep understanding of complex organisational structures of public employers in the military sector;
- the fundamental importance of gathering evidence, including when dealing with classified information.
This case is part of the consistent development of JDP practice covering services regarding investment projects carried out for the Polish defence sector, including infrastructure projects of strategic importance.
