Competition and consumer protection

Attorney-at-law with over ten years of experience. Head of the Competition and Consumer Protection Practice. He specialises in legal advice to leading Polish and foreign entities from the banking, financial and insurance sectors as well as the FMCG, chemical, automotive, real estate and production industries. He has extensive experience in advising on Polish and EU legislation on competition, including concentration control, antitrust-related aspects of entities’ collaborations and unilateral actions of dominant entities, contract advantage, unfair market practices and practices infringing the collective interests of consumers. Damian advises on M&A transactions (from planning and structuring the transaction to its closing), assists in implementing compliance programmes, reviews sales and marketing strategies, advises on inspections or searches by antitrust authorities, carries out audits, represents entities in proceedings before the President of the Competition and Consumer Protection Office and court appeal proceedings, and holds training sessions on competition and consumer protection.


Selected projects

  • representing several entities in antitrust proceedings concluded with a decision stating that the clients and other entities set up a JV without the approval by the President of the Competition and Consumer Protection Office, and imposing a fine of around PLN 234 million in total; advising on appealing against this decision,
  • advising one of the largest banks in Poland on appealing against a decision stating that practices infringing the collective interests of consumers had been applied and imposing a fine of around PLN 29 million,
  • advising a client on appealing against a decision stating that the Act on Contract Advantage had been breached by one of the largest retail chains in Poland and imposing a fine of around PLN 723 million,
  • advising a client on antitrust aspects of one of the largest transactions in Poland in the telecommunication sector (transaction value: around PLN 7 billion),
  • supporting the Helsinki Foundation for Human Rights pro bono in preparing a report on Poland’s execution of the European Court of Human Rights judgment issued in the case R.R. vs Poland.
